Can Your Home Country Still Tax You After Moving to Paraguay?
The goal is to build a tax setup that fits the way you actually live. Buying a residency package is only one part of that decision. Your former country, the countries where you work and your business structure can each affect the result.
Use this guide to prepare a focused conversation with a qualified home-country adviser. It is aimed at non-US travellers; US citizenship and other US tax connections need separate analysis.
Start with four questions
| Question | Information to prepare |
|---|---|
| Where am I resident for tax purposes? | Days, available homes, family ties and work patterns |
| What remains taxable after departure? | Property, employment, business interests and planned disposals |
| Where is my business operating? | Ownership, management, staff and where services are performed |
| What happens in the move year? | Departure date, tax year, filings and any split-year treatment |
Do this before treating projected tax savings as money available to spend. Two people with the same income and destination can have different results because their homes, work and company arrangements differ.
The 183-day shortcut does not work everywhere
Days matter, but they are not a universal safe harbour. Here are four examples of the different questions authorities ask.
| Country | Key residence questions | Official starting point |
|---|---|---|
| UK | Automatic overseas and UK tests, then sufficient ties; split-year treatment has its own conditions | HMRC Statutory Residence Test |
| Spain | More than 183 days, economic interests and a rebuttable family presumption; sporadic absences can count | Spanish Tax Agency |
| France | Home or principal stay, main professional activity, or centre of economic interests | French tax authority |
| Germany | A home maintained for use and habitual abode are relevant; deregistration is not the whole analysis | Fiscal Code, sections 8–9 |
These are starting points, not complete country exit instructions. Do not substitute one country’s test for another. If two countries both treat you as resident, check whether an applicable treaty provides relief and how it applies. Do not assume a treaty exists or that a certificate automatically decides the result.
What changes when Paraguay enters the picture?
Paraguay can provide a residence base and the relevant local documents. Keep the permit, identity card and tax registration separate in your planning. The Paraguay setup guide explains the sequence.
The source of your income still needs checking. DNIT’s published analysis of services performed abroad distinguishes that work from services performed inside Paraguay for foreign clients. An overseas customer alone does not settle the issue. DNIT consultation 828.
Make a work-location calendar as well as a travel calendar. A holiday, a remote working stay and managing a company from a country can raise different questions.
Does everyone need a US LLC?
No. Choose a company structure for your business rather than treating it as a required tax-exit step. Your adviser should review the entity’s treatment in every relevant jurisdiction, your activities and how you receive money from it.
“Disregarded” also does not mean “no paperwork”. The IRS requires certain foreign-owned US disregarded entities with reportable transactions to file Form 5472 with a pro forma Form 1120. IRS filing instructions.
Ask for the total ongoing cost and a clear responsibility list before opening another company. If you already have one, establish whether changing it solves a real problem.
Build an evidence file that matches your life
- Keep entry and exit dates, travel confirmations and accommodation records.
- Record which homes remain available to you and where close family lives.
- Keep contracts, work-location records and details of company management.
- Retain submitted returns, notices, certificates and written advice.
- Update banks and authorities accurately when your circumstances change.
- Recheck the plan before a large asset sale or a return to your former country.
Do not manufacture a paper trail to disguise where you live. Its value is that it supports what actually happened.
Calculate savings using your own numbers
Compare your current annual tax and compliance cost with the expected tax, compliance, travel and setup costs after the move. Include any one-off exit charges. A headline “0%” destination is not a substitute for that calculation.
For Paraguay, our current cost guide separates the service price, government fees and travel. The first useful outcome is a workable plan, including what you must keep doing after departure.
